Terms of Service

1. Acceptance of Terms

By accessing or using Playlist Panda, you agree to be bound by these Terms of Service. By creating an account or signing up for Playlist Panda, you acknowledge that you have read and agree to these Terms and our Privacy Policy. If you do not agree to these terms, please do not use our service. Continued use of the platform after any updates to these Terms constitutes acceptance of the revised Terms.

2. Description of Service

Playlist Panda is a platform that connects music artists with Spotify playlist curators. Artists can submit their music for consideration, and curators can review and potentially add tracks to their playlists. Playlist Panda is an independent service and is not affiliated with, endorsed by, or sponsored by Spotify AB or any of its affiliates.

3. User Accounts

  • You must be at least 18 years old to use this service
  • You are responsible for maintaining the security of your account
  • You may not use another person’s account without permission
  • One account per person; your account may include both artist and curator roles when enabled
  • You agree to provide accurate, current, and complete information during registration and to keep your account information updated

4. Artist Terms

  • You must own or have rights to the music you submit
  • Submissions do not guarantee playlist placement
  • Credits are non-refundable once used for submissions
  • Tracks are subject to platform submission limits to prevent spam and duplicate pitching (default limits may change over time)
  • Monthly subscription credits reset each billing cycle; 25% of unused credits roll over for one period
  • Purchased one-time credits do not expire and are separate from subscription credits
  • Subscription pricing, credit allocations, and tier structures are subject to change; active subscribers will be notified in advance of any changes to their plan

5. Curator Terms

  • Playlists must have at least 50 genuine Spotify followers to be eligible for the platform
  • You must respond to all submissions within 72 hours with meaningful feedback (minimum 20 characters)
  • If you approve a submission, you are expected to add the track to your playlist in good faith; approval without placement may affect your standing and earnings
  • Playlist Panda may periodically verify that approved tracks remain on your playlists; removing tracks within 24 hours of approval may result in point penalties
  • You must not accept payment, gifts, or incentives outside of Playlist Panda in exchange for playlist placement
  • By registering as a curator on Playlist Panda, you grant Playlist Panda a non-exclusive right to add playlists to or remove playlists from your curator profile at our discretion. This may be exercised to maintain platform accuracy, improve discoverability, ensure genre alignment, or uphold overall curation quality. We will exercise this right in good faith.
  • Playlist Panda may update, reorganize, or remove playlist associations on your profile without prior notice. It remains your responsibility to ensure that any playlists displayed on your profile accurately reflect content you are willing to accept submissions for.
  • You may operate more than one curator profile, but profiles that share the same payout method (for example, the same PayPal email or bank account) are treated as a single participant for the purposes of the individual payout cap and earnings distribution
  • Fraudulent activity — including fake followers, artificial engagement, or gaming the compensation system — will result in account termination and forfeiture of all earnings

6. Curator Compensation

  • Curators participate in a monthly revenue-share model as described in the Playlist Panda Curator Compensation Plan
  • A percentage of monthly artist revenue is allocated to a curator pool and distributed proportionally based on points earned through platform activity, including reviews, feedback quality, response speed, playlist presence, and track retention
  • Monthly playlist-presence points are awarded up to a published per-curator playlist cap; playlists beyond that cap do not earn additional presence points, though they remain eligible for review and retention points
  • Curators earn a monthly loyalty (tenure) bonus that grows with each active month they participate, up to a published cap; tenure accrues only in months a curator is eligible to earn from the pool, and inactive or gated months neither add to nor reset accrued tenure
  • Suspended accounts do not participate in the monthly pool and do not earn presence, tenure, or other points while suspended; accrued tenure is retained and resumes if the account is reinstated
  • An individual cap limits the maximum share any single curator can receive in a given month to ensure fair distribution; overflow amounts are redistributed to other curators
  • The individual cap applies per payout destination: curator profiles sharing the same payout method (such as the same PayPal email or bank account) are combined and share a single cap, rather than each receiving a separate one
  • To receive earnings from the monthly pool, a curator must complete a minimum number of reviews each month, up to the number of submissions they received that month; curators who fall below this participation minimum remain part of the network but do not earn from the pool for that month, and their points are redistributed to participating curators
  • Payouts below the minimum threshold (currently $5.00) roll into the following month rather than being paid out immediately
  • The current minimum withdrawal target is $20.00 when withdrawals are enabled; timing and payout rails may vary by rollout stage and region
  • Playlist Panda reserves the right to adjust compensation rates, point weights, pool percentages, cap thresholds, and payout minimums at any time with reasonable notice to curators
  • Curators are solely responsible for reporting and paying any taxes owed on earnings received from Playlist Panda; the platform may issue tax documents (e.g., IRS Form 1099) as required by law for U.S.-based curators
  • Earnings from curator activities are not guaranteed and depend on platform revenue, curator participation, and the compensation model in effect at the time

7. Curator Services Marketplace

  • The Marketplace lets curators offer optional paid services (for example, feedback, promotion, or production help) to artists. It is separate from playlist submissions and from the monthly curator compensation pool.
  • Marketplace purchases are one-time payments processed through Stripe. Playlist Panda collects the full price and retains a platform fee of 15%; the selling curator receives 85% of the listing price.
  • Funds are held by Playlist Panda until the order is complete. After the artist confirms delivery, or after an automatic confirmation window passes with no response from the artist, the curator’s share is released and becomes withdrawable following a short clearance hold.
  • If a curator does not deliver by the stated deadline, the order is automatically cancelled and the artist is refunded in full.
  • While funds are still held, an artist may request a revision or open a dispute. Playlist Panda reviews disputes and may, at its discretion and based on the available evidence, refund the artist or release payment to the curator. Our decision on a marketplace dispute is final.
  • If a curator’s account is terminated or deleted while orders are still in progress, affected artists are refunded and any not-yet-cleared curator earnings on those orders are forfeited.
  • All communication, delivery, and payment for marketplace orders must stay on Playlist Panda. Sharing or requesting contact details, or arranging or requesting payment outside Playlist Panda, is prohibited and may result in listing removal, order cancellation, or account termination.
  • Curators are limited to a set number of active listings (currently up to three per curator); this limit may change over time. Listings, including edits that materially change the offer, are subject to review and approval before going live, and each listing must include a representative image.
  • Listing content must be accurate and not misleading, and may not offer anything that violates these Terms, Spotify’s policies, or applicable law — including, without limitation, guaranteed placement, streams, followers, or chart results; bots or artificial engagement; or any illegal, infringing, or deceptive service.
  • Editing or pausing a listing never changes the terms of an order an artist has already purchased; each order is fulfilled on the terms shown at the time of purchase.
  • Playlist Panda is not the author of, and does not guarantee, any curator’s marketplace work product. Curators are solely responsible for the services they provide and for reporting and paying any taxes owed on marketplace earnings.
  • Playlist Panda may modify marketplace fees, listing limits, holding and clearance periods, and eligibility at any time with reasonable notice, and may suspend or discontinue the Marketplace at its discretion.

8. Spotify Compliance

  • Playlist Panda facilitates connections between artists and curators; we do not guarantee or control any actions on the Spotify platform itself
  • Curators and artists must comply with Spotify’s Terms of Service and Platform Rules at all times while using Playlist Panda
  • Playlist Panda does not use Spotify’s API for playlist manipulation; playlist verification is performed through publicly available data
  • You may not use Playlist Panda to engage in any activity that violates Spotify’s policies, including but not limited to: artificial streaming, fake followers, playlist manipulation through bots, or pay-for-play schemes that circumvent Spotify’s guidelines
  • Playlist Panda pays curators for their time reviewing submissions and providing feedback — not for playlist placement itself; placement decisions are at the sole discretion of the curator
  • Spotify and/or your music distributor may, at their sole discretion, flag, restrict, mute, or remove tracks, releases, or entire catalogs for suspected artificial streaming or other policy reasons. Such enforcement actions are made solely by Spotify and/or your distributor, are outside Playlist Panda’s control, and may be triggered by third-party activity that Playlist Panda does not cause, authorize, or control. Playlist Panda does not guarantee that any track, release, or catalog will not be flagged, restricted, or removed by Spotify or your distributor.
  • Placing your music on independent, third-party playlists exposes it to audiences and traffic sources outside our control. Streams, saves, followers, or other engagement generated by any third party — including bad actors who may attempt to harm an artist through artificial streaming directed at a track or playlist — are outside Playlist Panda’s control. Playlist Panda is not responsible or liable for any Spotify or distributor enforcement action, or any loss of streams, revenue, royalties, or account standing, arising from such third-party activity.
  • You acknowledge that all music promotion on third-party platforms carries inherent risk, and that you use Playlist Panda at your own risk with respect to Spotify and distributor enforcement decisions.
  • If Spotify updates its policies in a way that affects our service, we may modify or discontinue features as necessary to remain compliant

9. Prohibited Conduct

  • Creating fake accounts or artificially inflating playlist followers or streaming numbers
  • Submitting music you do not have rights to distribute or promote
  • Harassment, abuse, or threatening behavior toward other users
  • Attempting to bypass platform fees, credit systems, or compensation structures
  • Using automated systems, bots, or scripts to interact with the platform
  • Soliciting or accepting off-platform payments for playlist placements
  • Soliciting, arranging, or accepting off-platform payment or contact for marketplace services, or otherwise moving a marketplace order off Playlist Panda
  • Manipulating the point system through fake reviews, coordinated schemes, or any form of fraud
  • Sharing account credentials or allowing unauthorized access to your account

10. Payments, Billing, and Refunds

  • All payments are processed securely through Stripe; Playlist Panda does not store your payment card information
  • Artist subscription fees are charged monthly at the beginning of each billing cycle
  • Curator payouts are calculated monthly and credited to the curator’s platform balance; withdrawals are processed through supported payout rails when available
  • Refunds for unused subscription credits may be issued at our discretion on a case-by-case basis; credits consumed for submissions are non-refundable
  • Marketplace purchases are held by Playlist Panda and released to the selling curator after the order is completed; refunds for marketplace orders are governed by the Curator Services Marketplace section above
  • Playlist Panda is not responsible for fees charged by your bank, payment provider, or tax authority in connection with transactions on our platform

11. Privacy and Data

  • We collect and process personal data necessary to provide our services, including your name, email address, and Spotify profile information
  • Your data is used to facilitate submissions, verify playlists, calculate earnings, and improve the platform experience
  • We do not sell your personal data to third parties
  • By using Playlist Panda, you consent to the collection and use of your information as described in these Terms and our Privacy Policy at /privacy
  • You can delete your account from available account settings or request deletion assistance by contacting support@playlistpanda.com

12. Termination

  • We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice
  • You may close your account from available account settings or by contacting support; upon closure, pending earnings below applicable payout thresholds may be forfeited
  • Upon termination for cause (e.g., fraud, policy violations), all accrued earnings may be forfeited
  • Sections relating to liability, intellectual property, and dispute resolution survive termination

13. Platform Availability and Technical Issues

  • Playlist Panda is provided on an 'as available' basis; temporary outages, delays, third-party service interruptions, and unexpected technical errors can occur
  • We may perform maintenance, updates, or emergency changes that temporarily impact features, submissions, payouts, or account access
  • If a technical error causes an incorrect charge, credit allocation, balance, or submission state, we may investigate and apply corrective adjustments, including reversals, credits, or refunds where appropriate
  • Our internal records, logs, and payment processor records are authoritative for resolving transactional discrepancies
  • You agree to promptly report suspected billing or account errors to support so we can investigate within a reasonable timeframe

14. Disclaimers

  • We do not guarantee uninterrupted service, error-free operation, or specific business outcomes
  • We do not guarantee playlist placement results, stream performance, discovery outcomes, or curator response behavior beyond platform policy expectations
  • We do not guarantee that your music will not be flagged, restricted, or removed by Spotify or your distributor, and we are not responsible for third-party artificial streaming or other third-party activity that may affect your streams, royalties, or standing on Spotify or any other platform
  • Third-party platforms and providers (including Spotify and Stripe) may change functionality, policies, or availability at any time, which may affect our service
  • Except as required by law, Playlist Panda disclaims all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement

15. Limitation of Liability

Playlist Panda is provided "as is" and "as available" without warranties of any kind, express or implied. We are not responsible for playlist placement outcomes, third-party actions, Spotify platform changes, or any indirect, incidental, or consequential damages. Our total liability is limited to the amount you have paid to Playlist Panda in the twelve (12) months preceding the claim.

16. Indemnification

You agree to defend, indemnify, and hold harmless Playlist Panda and its operators from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from your use of the service, your submitted content, your violation of these Terms, or your violation of any third-party rights.

17. Dispute Resolution; Arbitration; Class Action Waiver

  • These Terms are governed by the laws of the jurisdiction in which Playlist Panda operates, without regard to conflict-of-law principles
  • Before starting a formal claim, you agree to attempt good-faith informal resolution by sending a written dispute notice to support and allowing up to 30 days for resolution
  • If a dispute is not resolved informally, it may be resolved by binding individual arbitration administered by the American Arbitration Association (AAA), to the extent permitted by applicable law
  • Either party may bring an individual claim in small claims court if the claim qualifies
  • To the fullest extent permitted by law, disputes must be brought on an individual basis only, and not as a class, collective, representative, or private-attorney-general action
  • To the extent a dispute proceeds in court rather than arbitration, each party waives any right to a jury trial where legally permitted
  • If this arbitration section is found unenforceable for a specific claim, that claim may proceed in a court of competent jurisdiction, and the remaining Terms remain in effect

18. Modifications to Terms

We may update these Terms from time to time. When changes are material, we may provide notice through email, in-product messaging, or an updated effective date on this page, as appropriate and as required by applicable law. Your continued use of Playlist Panda after the effective date of any changes constitutes acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the platform and close your account.
