1. Acceptance of Terms
By accessing or using Playlist Panda, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service. Continued use of the platform after any updates to these Terms constitutes acceptance of the revised Terms.
2. Description of Service
Playlist Panda is a platform that connects music artists with Spotify playlist curators. Artists can submit their music for consideration, and curators can review and potentially add tracks to their playlists. Playlist Panda is an independent service and is not affiliated with, endorsed by, or sponsored by Spotify AB or any of its affiliates.
3. User Accounts
- You must be at least 18 years old to use this service
- You are responsible for maintaining the security of your account
- You may not use another person’s account without permission
- One account per role (you cannot be both artist and curator on the same account)
- You agree to provide accurate, current, and complete information during registration and to keep your account information updated
4. Artist Terms
- You must own or have rights to the music you submit
- Submissions do not guarantee playlist placement
- Credits are non-refundable once used for submissions
- Each track can only be submitted 3 times total across the platform
- Monthly subscription credits reset each billing cycle; 25% of unused credits roll over for one period
- Purchased one-time credits do not expire and are separate from subscription credits
- Subscription pricing, credit allocations, and tier structures are subject to change; active subscribers will be notified in advance of any changes to their plan
5. Curator Terms
- Playlists must have at least 50 genuine Spotify followers to be eligible for the platform
- You must respond to all submissions within 72 hours with meaningful feedback (minimum 20 characters)
- If you approve a submission, you are expected to add the track to your playlist in good faith; approval without placement may affect your standing and earnings
- Playlist Panda may periodically verify that approved tracks remain on your playlists; removing tracks within 24 hours of approval may result in point penalties
- You must not accept payment, gifts, or incentives outside of Playlist Panda in exchange for playlist placement
- By registering as a curator on Playlist Panda, you grant Playlist Panda a non-exclusive right to add playlists to or remove playlists from your curator profile at our discretion. This may be exercised to maintain platform accuracy, improve discoverability, ensure genre alignment, or uphold overall curation quality. We will exercise this right in good faith.
- Playlist Panda may update, reorganize, or remove playlist associations on your profile without prior notice. It remains your responsibility to ensure that any playlists displayed on your profile accurately reflect content you are willing to accept submissions for.
- Fraudulent activity — including fake followers, artificial engagement, or gaming the compensation system — will result in account termination and forfeiture of all earnings
6. Curator Compensation
- Curators participate in a monthly revenue-share model as described in the Playlist Panda Curator Compensation Plan
- A percentage of monthly artist revenue is allocated to a curator pool and distributed proportionally based on points earned through platform activity, including reviews, feedback quality, response speed, playlist presence, and track retention
- An individual cap limits the maximum share any single curator can receive in a given month to ensure fair distribution; overflow amounts are redistributed to other curators
- Payouts below the minimum threshold (currently $5.00) roll into the following month rather than being paid out immediately
- The minimum withdrawal amount is $20.00; withdrawals are processed through Stripe
- Playlist Panda reserves the right to adjust compensation rates, point weights, pool percentages, cap thresholds, and payout minimums at any time with reasonable notice to curators
- Curators are solely responsible for reporting and paying any taxes owed on earnings received from Playlist Panda; the platform may issue tax documents (e.g., IRS Form 1099) as required by law for U.S.-based curators
- Earnings from curator activities are not guaranteed and depend on platform revenue, curator participation, and the compensation model in effect at the time
7. Spotify Compliance
- Playlist Panda facilitates connections between artists and curators; we do not guarantee or control any actions on the Spotify platform itself
- Curators and artists must comply with Spotify’s Terms of Service and Platform Rules at all times while using Playlist Panda
- Playlist Panda does not use Spotify’s API for playlist manipulation; playlist verification is performed through publicly available data
- You may not use Playlist Panda to engage in any activity that violates Spotify’s policies, including but not limited to: artificial streaming, fake followers, playlist manipulation through bots, or pay-for-play schemes that circumvent Spotify’s guidelines
- Playlist Panda pays curators for their time reviewing submissions and providing feedback — not for playlist placement itself; placement decisions are at the sole discretion of the curator
- If Spotify updates its policies in a way that affects our service, we may modify or discontinue features as necessary to remain compliant
8. Prohibited Conduct
- Creating fake accounts or artificially inflating playlist followers or streaming numbers
- Submitting music you do not have rights to distribute or promote
- Harassment, abuse, or threatening behavior toward other users
- Attempting to bypass platform fees, credit systems, or compensation structures
- Using automated systems, bots, or scripts to interact with the platform
- Soliciting or accepting off-platform payments for playlist placements
- Manipulating the point system through fake reviews, coordinated schemes, or any form of fraud
- Sharing account credentials or allowing unauthorized access to your account
9. Payments, Billing, and Refunds
- All payments are processed securely through Stripe; Playlist Panda does not store your payment card information
- Artist subscription fees are charged monthly at the beginning of each billing cycle
- Curator payouts are calculated monthly and credited to the curator’s platform balance; withdrawals are initiated by the curator and processed via Stripe
- Refunds for unused subscription credits may be issued at our discretion on a case-by-case basis; credits consumed for submissions are non-refundable
- Playlist Panda is not responsible for fees charged by your bank, payment provider, or tax authority in connection with transactions on our platform
10. Privacy and Data
- We collect and process personal data necessary to provide our services, including your name, email address, and Spotify profile information
- Your data is used to facilitate submissions, verify playlists, calculate earnings, and improve the platform experience
- We do not sell your personal data to third parties
- By using Playlist Panda, you consent to the collection and use of your information as described herein; a full Privacy Policy may be published separately
- You may request deletion of your account and associated data by contacting support@playlistpanda.com
11. Termination
- We reserve the right to suspend or terminate accounts that violate these Terms, at our sole discretion and without prior notice
- You may close your account at any time by contacting support; upon closure, any pending earnings below the withdrawal minimum will be forfeited
- Upon termination for cause (e.g., fraud, policy violations), all accrued earnings may be forfeited
- Sections relating to liability, intellectual property, and dispute resolution survive termination
12. Limitation of Liability
Playlist Panda is provided "as is" and "as available" without warranties of any kind, express or implied. We are not responsible for playlist placement outcomes, third-party actions, Spotify platform changes, or any indirect, incidental, or consequential damages. Our total liability is limited to the amount you have paid to Playlist Panda in the twelve (12) months preceding the claim.
13. Modifications to Terms
We may update these Terms from time to time. Material changes will be communicated via email or an in-platform notification at least 14 days before taking effect. Your continued use of Playlist Panda after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree with the updated Terms, you must stop using the platform and close your account.
